These Terms & Conditions of Sale (“T&C”) apply to all purchases made on the Divine Shape website.

By placing an order, the customer acknowledges having read, understood, and accepted these Terms without reservation.

3. Sales Territory

Divine Shape sells exclusively to customers located in the United States and Canada.

Orders from other countries, including the European Union, are not accepted.

4. Products

Products offered for sale are those displayed on the website at the time of purchase.

Product descriptions, images, and sizing charts are provided for informational purposes only.
Minor variations in color or appearance may occur due to screen settings or manufacturing differences.

5. Prices

All prices are displayed in the currency indicated on the website.

Prices may be modified at any time without prior notice.
The price charged is the one displayed at the time the order is placed.

Shipping fees and applicable taxes are calculated at checkout.

6. Orders

An order is confirmed once:

  • payment has been successfully processed, and

  • an order confirmation email has been sent to the customer

Divine Shape reserves the right to cancel or refuse any order in case of:

  • suspected fraud

  • payment issues

  • incorrect or incomplete customer information

  • pricing or inventory errors

7. Payment

Payments are processed through secure third-party providers (such as Shopify Payments or PayPal).

Divine Shape does not store or have access to customers’ full payment details.

8. Shipping & Delivery

Orders are processed within 1 to 3 business days.

Estimated delivery time is 5 to 10 business days after shipment.
Delivery times are estimates and not guaranteed.

Divine Shape is not responsible for delays caused by:

  • shipping carriers

  • customs procedures

  • incorrect address information provided by the customer

  • circumstances beyond our control

9. Transfer of Risk

Risk of loss or damage to the products transfers to the customer once the order has been delivered to the address provided.

10. Returns & Refunds

Divine Shape does not offer refunds or exchanges.

Returns are governed strictly by our Return & Refund Policy, which includes:

  • no cash refunds

  • store credit only under specific conditions

  • store credit validity of 6 months

  • customer-paid return shipping

  • final sale on promotional items

By placing an order, the customer expressly agrees to these conditions.

11. Sizing Responsibility

Sizing errors or preference issues do not qualify for refunds or exchanges.

Customers are solely responsible for reviewing the sizing guide prior to placing an order.

12. Promotional & Sale Items

Items purchased during sales, promotions, or marked as FINAL SALE:

  • are non-refundable

  • non-exchangeable

  • not eligible for store credit

13. Defective or Incorrect Products

In the event of a defective product or an incorrect item shipped due to our error, the customer must contact us within 48 hours of delivery, providing photographic evidence.

After verification, Divine Shape will offer:

  • a replacement, or

  • a store credit

14. Liability Limitation

Divine Shape shall not be held liable for indirect, incidental, or consequential damages resulting from the use of the products or website.

Products are provided “as is” and “as available”.

15. Force Majeure

Divine Shape shall not be held responsible for failure to fulfill obligations due to events beyond reasonable control, including but not limited to natural disasters, strikes, supply chain disruptions, or carrier delays.

16. Intellectual Property

All website content, including text, images, logos, and designs, is the exclusive property of Divine Shape and may not be used without prior written consent.

17. Governing Law

These Terms & Conditions of Sale are governed by and construed in accordance with the laws of the United States, without regard to conflict of law rules.

Divine Shape reserves the right to modify these Terms & Conditions at any time.

The applicable version is the one in effect on the date the order is placed.
